Viridian Public Violations Policy (VDViolP)
===
The Viridian Public Violations Policy (VDViolP) regulates how the Viridian Administration will respond to violations of VDCondC and other policies in effect on VDPR.
1: Fundamentals
---
1. VDPR employs a penalty point system for enforcement of its policies. Violations add points to the offending user's penalty score and expire after a specific time period.
2. Initially, users have a penalty score of zero points.
3. The specific rules in effect on VDPR explicitly state the amount of points associated with each violation. If no such declaration is present for a specific rule, this rule is not enforced under VDViolP. Rules cannot weigh more than twenty points.
4. The Viridian Administration reserves its virtual domiciliary right and statutory rights under Section 314 of the German Civil Code to suspend or terminate user accounts regardless of Viridian Public Policy in the event of abuse, harm, illegal content, spam, or platform security risks.
5. Time windows are based on universal time (UTC, Z).
2: Determination of Violations
---
1. Violations are observed by the Viridian administration (a) when encountered by the administration upon search or by coincidence, or (b) when reported by another user.
2. Simultaneous breach of multiple VDPOL rules is considered one violation, and the respective penalty points are aggregated. *Example: if a user violates one rule worth two points, and another rule worth three points in one single comment, this counts as one violation worth five points.*
3. The expiry of a violation in days is determined by multiplying the amount of penalty points with ten. This expiry is counted from the day after determination of the violation by the Viridian Administration. *Example: if a user is found guilty of a five-point violation, these five penalty points are counted towards their penalty score for a duration of fifty days.*
3: Enforcement of Policy
---
1. Based on a user's penalty score, the Viridian Administration will take action in accordance with this section.
2. Accounts with a penalty score of three or higher may be monitored more closely in regard of any action taken on VDPR.
3. Accounts with a penalty score of six or higher are suspended. This suspension is lifted once their penalty score falls below six.
4. Accounts with a penalty score of twelve or higher are purged from VDPR. This implies deletion of their profile, repositories, organisations, and comments.
5. Accounts which have been suspended three times within twelve consecutive months are purged in accordance with subsection four.
4: Penalty Records and Notices
---
1. In order to enforce Viridian Public Policy, the Viridian Administration creates and maintains penalty records of offending users. Users who have not violated Viridian Public Policy do not have such records.
2. Violations are tracked on internal tickets not visible to the public. Violations for each user are universally identified by the respective ticket number.
3. Users have access to their own penalty records and penalty score upon request by e-mail or directly on VDPR when not suspended.
4. Users are notified about changes to their penalty score on VDPR via these records, and via e-mail.
5. Users may object to penalties by replying to the respective tickets, or by e-mail.
6. Violation tickets are closed once expired and deleted after a maximum of three years.
7. New tickets opened by users on their penalty record repository are ignored by the Viridian Administration.
8. The retention of penalty records is subject to [Section 7 VDPrivP](https://vdpr.org/VDPOL/Policies/src/branch/main/privacy-en.md).
